Overview

This website and online store are operated by Odd Atrium. Throughout these Terms of Service, the terms “Odd Atrium,” “we,” “us” and “our” refer to Odd Atrium.

These Terms of Service govern your access to and use of our website, online store, content, products and related services.

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer and sell our products.

By accessing our website or placing an order, you agree to these Terms of Service and the policies referenced in them. If you do not agree, please do not use the website or purchase products from the store.

Nothing in these Terms limits rights or remedies that cannot legally be waived under applicable consumer-protection law.

1. Eligibility and Customer Information

You must be the age of majority in your province, state or country of residence, or have the permission of a parent or legal guardian, to place an order.

You agree to provide current, complete and accurate information during checkout, including your:

• Name
• Email address
• Billing information
• Shipping address
• Payment information

You are responsible for checking your order details before submitting your purchase.

You must not use false information, impersonate another person or use a payment method that you are not authorized to use.

2. Products and Product Images

Odd Atrium sells made-to-order apparel and related products.

We make reasonable efforts to display product colours, artwork, scale, materials and appearance accurately. However:

• Colours may appear differently depending on your screen and device settings.
• Product placement and print scale may vary slightly because garments are produced individually.
• Minor variations may occur between production runs.
• Garment measurements may vary within normal manufacturing tolerances.

These ordinary variations are not automatically considered defects.

Product descriptions, prices, colours, sizes and availability may be changed or discontinued without notice.

3. Made-to-Order Production

Odd Atrium products are produced on demand through our apparel fulfilment partner, Printful.

Production normally begins shortly after an order is submitted. Because each product is made specifically for the customer, changes or cancellations cannot be guaranteed after production begins.

Customers are responsible for reviewing product descriptions, colour selections and size guides before purchasing.

4. Orders and Acceptance

Submitting an order is an offer to purchase products from Odd Atrium.

An automated order confirmation acknowledges that we have received your order. We may review, decline or cancel an order where reasonably necessary, including when:

• A product is unavailable.
• Payment cannot be authorized.
• The order appears fraudulent or unauthorized.
• Customer or shipping information is incomplete.
• A material pricing or product-description error occurred.
• The order violates these Terms or applicable law.

If we cancel a paid order, the applicable amount will be refunded to the original payment method.

We may limit quantities purchased per person, household, address, payment method or order when reasonably necessary.

5. Prices, Currency and Taxes

Prices are displayed in the currency shown on the website or during checkout.

The final amount charged may include:

• Product prices
• Applicable sales taxes
• Shipping charges
• Discounts or promotional adjustments
• Other charges clearly displayed before checkout is completed

Prices and promotions may change without notice. Price changes do not apply retroactively to orders already accepted.

Customers are responsible for any customs duties, import taxes or other government charges that may apply to their shipment unless checkout expressly states that those charges are included.

6. Payments

Payments may be processed through:

• Shopify Payments
• PayPal
• Shop Pay
• Apple Pay
• Google Pay
• Other payment methods displayed during checkout

Odd Atrium does not directly receive or store your complete payment-card number.

Payment processing is also subject to the terms and privacy practices of the selected payment provider.

You authorize Odd Atrium and its payment providers to charge the total amount displayed during checkout to your selected payment method.

7. Shipping and Delivery

Current production estimates, shipping regions, delivery estimates, free-shipping eligibility and tracking information are described in our Shipping Policy.

Production and delivery dates are estimates unless we expressly state otherwise. Delays may occur because of:

• Carrier disruptions
• Severe weather
• High-volume periods
• Holidays
• Customs processing
• Incorrect or incomplete addresses
• Product availability
• Events outside our reasonable control

Customers are responsible for providing an accurate and complete shipping address.

Please contact hello@oddatrium.com promptly if an order is delayed, lost, damaged or delivered incorrectly.

Customer rights concerning delayed or undelivered orders remain subject to applicable consumer-protection law.

8. Returns, Refunds and Exchanges

Returns, refunds, replacements, cancellations and exchanges are governed by our Return & Refund Policy.

Because products are made to order, we do not ordinarily accept returns or exchanges because of:

• Incorrect size selection
• Fit preference
• Colour preference
• Change of mind
• Buyer’s remorse

Damaged, defective, misprinted or incorrect products may qualify for a replacement or refund when reported within the period and with the evidence specified in our Return & Refund Policy.

Nothing in this section limits any non-waivable rights available under applicable law.

9. Promotions and Discounts

Discounts, free-shipping offers and promotions may be subject to separate eligibility requirements, including:

• Minimum order quantities
• Minimum purchase amounts
• Eligible products
• Geographic restrictions
• Start and end dates
• Combination restrictions

Unless otherwise stated, promotions have no cash value and cannot be applied to earlier purchases.

The final discount displayed at checkout determines the promotion applied to an order.

10. Intellectual Property

The Odd Atrium website and its original content—including artwork, illustrations, graphics, photographs, videos, audio, logos, product names, designs, written material and website presentation—are owned by or licensed to Odd Atrium and are protected by applicable intellectual-property laws.

Purchasing a product does not transfer ownership of the artwork or grant permission to reproduce or commercially exploit it.

Without prior written permission, you may not:

• Copy or reproduce Odd Atrium artwork.
• Sell unauthorized reproductions.
• Use our designs on other products.
• Modify and redistribute our content.
• Use Odd Atrium content to promote another business.
• Scrape or systematically download website content.
• Claim our work as your own.
• Use our content to train, develop or supply a commercial artificial-intelligence system or dataset.

Personal photographs of products you legally purchased are permitted, including photographs shared on social media, provided they are not used to sell unauthorized reproductions or misrepresent an affiliation with Odd Atrium.

All rights not expressly granted are reserved.

11. Acceptable Website Use

You may use the website only for lawful personal and shopping purposes.

You must not:

• Violate applicable laws or regulations.
• Infringe intellectual-property or privacy rights.
• Upload malware or harmful code.
• Attempt to bypass security measures.
• Interfere with the website or checkout.
• Scrape or harvest customer information.
• Commit fraud or payment abuse.
• Impersonate another person.
• Use automated systems to disrupt or exploit the store.
• Use the website in a manner that harms Odd Atrium, Shopify, our providers or other customers.

We may restrict access, cancel orders or take other reasonable action when these Terms are violated.

12. Third-Party Services and Links

The store relies on third-party services, including Shopify, Printful, payment processors, shipping carriers and other operational providers.

Your use of third-party services may also be governed by those providers’ terms and privacy policies.

Links to third-party websites are provided for convenience. Odd Atrium does not control and is not responsible for the content, security, availability or privacy practices of independent third-party websites.

Purchases made from Odd Atrium are transactions between the customer and Odd Atrium. Shopify and Printful provide technology and fulfilment services but are not the retailer selling the product to you.

13. Privacy

Our collection, use, storage and disclosure of personal information are described in our Privacy Policy.

By using the store, you acknowledge that information may be processed by Shopify, Printful, payment providers, shipping carriers and other providers needed to operate the store and complete your order.

14. Errors and Corrections

Website information may occasionally contain typographical errors, inaccurate information or omissions relating to:

• Product descriptions
• Images
• Prices
• Promotions
• Shipping charges
• Delivery estimates
• Product availability

We may correct errors and update information when discovered.

Where an error materially affects an order, we may contact the customer to confirm the corrected information or cancel and refund the affected order, subject to applicable law.

15. Service Availability

We do not guarantee that the website will always be uninterrupted, secure or error-free.

The website may occasionally be unavailable because of maintenance, technical problems, security concerns or third-party service interruptions.

We may modify, suspend or discontinue website features without notice where reasonably necessary.

16. Disclaimer and Limitation of Liability

To the fullest extent permitted by applicable law, Odd Atrium is not responsible for indirect, incidental, special or consequential losses arising solely from the use or inability to use the website.

Odd Atrium is not responsible for losses caused by:

• Unauthorized customer-account access resulting from compromised customer credentials.
• Third-party websites not controlled by Odd Atrium.
• Circumstances outside our reasonable control.
• Customer misuse of products or website services.

These limitations do not apply where liability cannot legally be excluded or limited, including mandatory consumer rights and liability arising from fraud, wilful misconduct or other matters that applicable law does not permit us to exclude.

Nothing in these Terms excludes any warranty, condition, remedy or right that cannot legally be excluded.

17. Indemnification for Unlawful Use

To the extent permitted by law, you are responsible for losses or claims resulting from your unlawful use of the website, infringement of another person’s rights or material breach of these Terms.

This section does not make you responsible for losses caused by Odd Atrium’s own acts or omissions.

18. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue in effect.

19. No Waiver

If Odd Atrium does not immediately enforce a provision of these Terms, that does not mean we permanently waive the right to enforce it.

20. Governing Law

These Terms are governed by the laws of Alberta and the applicable federal laws of Canada.

Subject to any mandatory rights available to a customer in another jurisdiction, disputes may be brought before the courts of Alberta.

Nothing in these Terms removes a consumer’s right to use complaint procedures, courts or remedies available under applicable consumer-protection law.

21. Changes to These Terms

We may update these Terms to reflect changes in our store, services, providers, policies or legal obligations.

The current version will be posted on this page with an updated revision date.

Unless required by law, changes will not retroactively alter the terms governing an order already placed.

22. Entire Agreement

These Terms, together with our:

• Privacy Policy
• Return & Refund Policy
• Shipping Policy
• Other policies or promotion terms presented during checkout

form the agreement governing your use of the store and your purchases from Odd Atrium.

If a conflict exists, mandatory applicable law takes priority.
